Title: California Supreme Court Overturns Ban on Gay Marriage Post by: Rattiemama on May 15, 2008, 01:34:41 PM I know this can be a hot issue, and I am not trying to start a debate, I'm just overjoyed right now. You can see a short article here. (http://news.yahoo.com/s/ap/20080515/ap_on_re_us/gay_marriage) I was born and raised in San Francisco and I'm a huge supporter of gay rights. I know this is only a step, but to me today is practically a holiday!
To all the gay couples out there, fighting for a chance to marry . . . we're one step closer today! If you oppose gay marriage, I respect your right to your opinions, but I hope this thread can remain a celebration of people who are fighting for their freedom, winning a small battle, and not turn into anything heated or negative. I did a happy dance when I read the news after coming home from dropping my kittens off for their spays. I also called my girlfriend, who's at work and my mom, and my sister who is engaged to her girlfriend and was just going to go ahead and have a wedding whether it was legal or not, but now she can actually marry the woman who she loves, lives with, runs a business with and owns a house with...AWESOME!!!
Of course, this just means that all those anti-gay marriage folks are going to be campaigning big time to get the gay marriage ban amendment to our state constitution on the ballot come November. Tho', yup, I grew up with cool parents. Back when the fools here passed the "Defense of Marriage Act" (which was before any state had legalized gay marriage) - my mom promptly put a bumper sticker on her car "My marriage doesn't need defending. It made me cry.....I am so happy that these wonderful people that are in love can finally feel like they are equal. I know that marriage does not make the relationship strong, but to have a feeling that you "cannot" do something because of sexuality, must be plain horrible. I hope that the rest of United States can take the steps in making Americans truly equal. I hope anyone can marry anyone they want soon!

The reason he vetoed the bills when they went through the legislature was that he didn't think the legislature had the right to overturn the vote of the people, only the judicial system does, barring a vote from the people that repeals the law. It's going to be an interesting year seeing how the anti gay faction reacts to this.

This November will there is a lot at stake. Hopefully the presidential election will help create a higher voter turnout than the last time an anti-gay-marriage bill was on the ballot. Frankly I'm hoping it doesn't even make it to the ballot.
All of this could still be trumped by a national amendment as well. I am reminded of the civil rights movement and the way interracial marriage was demonized, defended, and fought for. I can only hope our national supreme court will be as fair minded as it was then. I just got back from the Castro, where a dog walking client of mine lives. The place is a buzz with people drinking toasts and talking about the change. It is a beautiful thing, and I hope we start having more gay marriages at city hall soon! My state (WI) already banned gay marriage. And what kills me about that, is that the way it was worded on the ballot for us to vote on made it VERY confusing. I strongly believe many people voted for the ban without meaning to. I know my dad did, and he's not a dumb man! I got ordained that year so I can perform my own darn ceremonies.
It would be horrible if the ban is passed in November. Those people who get legally married in the meantime are in for heartache if it does. The state will actually send a gay couple a letter telling them that their marriage has basically been cancelled. I don't know if I'd ever want to live through getting a letter like that. We've flirted with the idea of moving to CA so many times (my partner actually lived there for awhile, with friends; I've been there a few times, myself - Santa Cruz is where we'd want to settle). This puts another check in the "pro" box. As an aside, I went to college in WI and worked with Fair Wisconsin to try to educate people to vote no on the gay marriage ban. It was pretty crushing when it passed. :( People I knew even personally witnessed poll workers telling people that if they were confused, just vote yes. Love is love, who cares who loves whom?! I never understood that. I grew up in Germany and things are quite different there. Can you imagine the culture shock I encountered when I moved to rural Texas (straight from Germany) :shocked2:? I loved it there, nothing against Texas, but it was such a taboo there! When we got married in LA, I noticed how much more liberal people were in CA. I am glad people who happen to love the same sex can finally get married! My husband and I watched the news over and over again (thanks to DVR!) last night! Finally!!! But with gay marriage opponents all over the country pledging money to campaign for the constitutional amendment, it's scary. I'd rather have a law in place that says I can't marry my girlfriend than a constitutional amendment. 20-30 years from now, I think most people will support gay marriage, as they come to see that gay aren't evil child molestors, but right now, the public support is so close on both sides, it's a huge unknown whether or not the amendment will pass.
You can bet I'm encouraging all my friends and family member who don't vote to register and vote against this one thing, if they vote on nothing else. |
